Cut a long story short I purchased a car in 2005 anyhow in 2007 it was stolen I had finance on the car and gap but can not remember the gap company, my insurance paid me out £1700 which I forwarded to the finance company and the gap paid the rest...then in 2008 the finance company wrote to me and said there was £1000 still outstanding so spoke to them and we agreed I would pay another £400 I think so I paid them monthly payments by my debit card, on the final payment they sent me a letter stating the loan was all paid and finished that was during 2008. I remember about 8 months ago sorting out the letter draw and threw all the letters away! Anyhow I tried to change my car as I now need an automatic because of my back mad got refused credit......so I was advised to check my experian credit report which I have and to my horror the company that financed the car that was stolen have during 2010 until now every month they have said I owe £580 and am in arrears. It has destroyed my credit score it has come up 427 very poor because of these.... I phoned up the finance which is Birmingham mercantile and they have said they can not find my file but have now insisted if it says it on there then I owe it and have asked for a copy of the letter which states from them I have paid. I told them I have destroyed it as it was a few years ago!! Anyone know where I stand with this... I've not had any letters or debt letters from this company about the so called outstanding amount and I'm furious they have destroyed my credit rating....... Cheers J

I d say that as you havent moved house, that they would nt have had any problems finding you to issue/collect the debt. Email them, and re-itterate that you have cleared the original debt. If they continue to say you owe it, ask(again) for proof, and if they have none, ask them to remove the debt from their list. If they dont, its solicitor time I m afraid, but send them a letter/email stating that they ll be responsible for any costs incurred by you. Always best to communicate by some form of recordable media(email/letter), otherwise you end up going around in circles mate.
